The Wobbling pivot was that there was two men fighting over a bicycle and there were people listening to them in Attainment Square. There was a riot that had happened in China where there was a riot that happened and there were a lot of people protesting for domestic tranquility in Beijing. In the streets of Changing there were people in taxis and most of them that took a ride was businessman and foreigners because the fares prices were very high. There were policeman that were extremely violent or didn't care about their actions about how hey treated people in certain cities and china as a whole was corrupted.For example when some girl had been raped and killed there was no Justice against that and the family pleaded for a trial and they got it but it took a while. Another example is when the girl had got murdered and was raped and she died and the young girl funeral was held but officials said that killing is not a crime. Also there were people trying to fight for their individual rights like people had anger over the unsafe mines and the polluted water that was not safe to drink. There were unsafe working intuitions and endless demands of local officials for bribes and sex privileges.There had been a problem with the farming with the water supplies poisoned and their crops being ruined and there could be rising Incidences of cancer and that was a panic. There were peoples homes destroyed for no apparent reason and If they resisted thousands were fined and even going to Jail some of the time. The main two things that the officials wanted were money and power which they only got If from family or any kind of racial connections. There were many cities that were under attack in China and the people still protested and many were killed and very few police officers.If you broke any laws In China you may have been sentenced to death regarding these protests. There were other things Like Education, public safety; food security and culture were nit high state spendin g priorities but they focused more on passing examinations which meant you were a certain elite status. People discriminate for many reasons such as religion, race, and even for business and employment. It is one thing to have a preference over something else but to actually deny a person over what race, or religion they are is perverse. Now there are some positives when decisions are made about things depending on an individual’s race or religion. There are people who only want to date or marry to the same race, religion, culture, category, class, and things like that. And that does not always mean that they are being racist, stereotypical, prejudice or anything of that nature but that they simple are particular. There are even laws that require for workplaces to accommodate for their employees religion just along their religious practices will not bring problems to the employer. Some people take it past the limits to make people are attracted to the same sex feel different, unaccepted, or unwanted all because they are ignorant of that culture. They have no idea what it is like and instead of trying to comprehend, they use negativity. Now there is nothing wrong with not being gay, and disagreeing with it but an opinion does not have to be expressed in a way that may be harmful. Just because a person is not apart of a certain group does not excuse the act of disrespecting another group or category. A lot of individuals will argue that it is simply wrong, and that it should not be permitted due to religious reasoning. Yes, that does make a lot of since, but I am very sure that many people do things that go against their religion all the time, they just happen to be discrete. Some people are afraid or have been brought up to not over step the boundaries so when others do not abide by the same rules they are automatically looked down upon. Society assigns everyone a certain social identity. Which ever category a person is placed they tend to accept others who are from the same group as they are. Prejudice is derived from our tendency to divide world into ‘us’ and ‘them†( Musa, Prejudice Discrimination and Stereotype). This causes great division between people which is one of the reasons why a lot of people categorize other individuals. Being that prejudice, discrimination, and stereotype are in society there are social aspects and effects. â€Å"Exposure to derogatory ethnic labels can elicit conformity pressures with people wanting to fit-in† ( Musa, Prejudice Discrimination and Stereotype). Generally people fear to be outcast so they go with the crowd. Afraid that if they choose not to agree then they might become socially unexpected. â€Å"People can reduce their reliance on stereotypes by consciously saying no to association between stereotypes and specific social groups† ( Musa, Prejudice Discrimination and Stereotype). It would make a lot of since for people to simply not discriminate sadly that simply will not happen. Either way it may go it is up to the person on what they will choose to do, but social impact has a lot to do with the decisions people make. â€Å"Social influence plays a role in both maintenance and reduction discrimination, prejudice, and stereotypes. Evidence suggesting that members of their group hold less prejudiced views are out of line with most people of their group, they may change their views. † ( Musa, Prejudice Discrimination and Stereotype). â€Å"It may be conceived that because someone is guilty of discrimination that she is mean, angry and hateful, which very well may be the case. However, when we understand that within us all lies some form of discrimination, whether passive or aggressive, it should once again lead us to the conclusion that, of course, it is very easy to discriminate. (Why Is It So Easy To Discriminate? , eHow. com). Every person has their preferences, how they choose to go about them is completely their discretion. There are those who are prejudice, stereotypical, and who discriminate negatively acknowledge it and own up to it. â€Å"Each and every one of us stereotype and have a prejudice of something. Every single one of us. I stereotype fat people. I make fun of them, I call them lazy. Is it right? No. Should people suffering from obesity be kept from living their lives because of my prejudice and stereotypes of them? Absolutely not. † (Kriss 2010). Those who do discriminate have a point of view and some respectively explain them. Kriss discriminates against fat people, does she have that right? Yes, she knows that she should not do it, but she still stands by her opinion no matter what anyone else thinks. Everyone discriminates to a center extent because everyone has their own opinions, and make their own decision with different dependents. Yet and still there things that are wrong which happen to be connected to discriminating and even misconceptions. The way a person behaves is by far their own choice. People are raised differently, have different life experiences, and choose to surround themselves with certain crowds that may differ from others. There are exceptions and there are non exceptions, but being close minded will bring nothing but ignorance. There will always be discrimination because everyone will always have a preference. and there is really nothing that can be done about it. Also prejudice and stereotypes that comes with life. Everything has a positive and a negative.

Sherlock Holmes and the Speckled Band Essay At the start of the story there are small rises of tension and falls, the use of Victorian Melodrama creates drama for the reader. When Helen Stoner comes in and tells Holmes about her family it is slow paced and little or no tension at all. Then she tells of her sisters death, which makes the tension rise. In the story there two lulls before the storm which is when everything is quiet happy and slow paced but then the action breaks out and the pace and tension rise But we shall have horrors enough before the night is over for goodness sake let us have a quiet pipe and turn our minds for a few hours to something more cheerful. There are four main high points in the story, the last being the climax. This is where Dr Roylott dies. Sherlock Holmes was the first real fictional detective and is still very popular today. He was a private detective, not a member of the police force because in those days the police werent held in high regard. He was put on a pedestal by the people who read about him because he was fulfilling everything the police werent. Many of todays TV detectives are based on Holmes including Colombo, Jonathan Creek, Poirot and Morse. Sherlock Holmes is instantly recognizable in his deerstalker hat and his long cloak but actually these were not originally his clothes. Someone who was drawing him made them up. We also recognize him by his magnifying glass and that he plays the violin and smokes a pipe. He smokes his pipe when he is meditating or trying to work out a clue or puzzle. Holmes personality is very polite but not emotional, he is a middle class gentleman and very logical. He always tries to outdo the people he meets. He does this in the story when he describes how Miss Stoner arrives and when he straightened out the poker which Dr Roylott had bent in anger. Inspector Morse is very similar to Sherlock Holmes. He is recognized by his red car, his classical music and his love for real ale. His mannerisms are like those of Holmes too, he is a polite middle class gentleman, very clever but is abrupt. He cares inside but doesnt show it. Morse also has a sidekick who is called Lewis; he is like Holmes Dr Watson. The reason for a sidekick is to narrate the story, to make the detective look a lot cleverer and to be an ally to us the readers. I had no keener pleasure than in following Holmes in his professional investigations, and in admiring the rapid deductions, as swift as intuitions, and yet always founded on a logical basis, with which he unraveled the problems which were submitted to him. Obviously a murder mystery has to have a murder and we usually find out who the murderer is at the end of the story. The Speckled Band is quite unusual because we know that Roylott is the killer but we dont know how he does it. Dr Roylott has an imposing physique and the author associates him with what we would generally consider bad using similes and metaphors. He is an archetypal villain and his only friends are wandering gypsies that arent trusted by others. These gypsies are associated with exotic pets and curses. Roylott is reclusive and has a beastly nature. He planned the murder in advance and spent and spent plenty of money on making sure that it took place. If Roylott is the archetypal villain then Helen Stoner is the archetypal victim. In Victorian literature women were portrayed as heroines who need help from heroes. Helen Stoner is weak, vulnerable and very emotional. She brings the only element of emotion into his story. She is emotional where as Holmes is logical. She plays a vital role in the story because she is the stepdaughter of the murderer, the sister of the murdered and the next in line. Helen Stoner is the stereotypical female of her time. She is like the prey and Roylott is the predator. When she comes to see Holmes her appearance is old and worn out. Her face all drawn and grey, with restless frightened eyes, like those of some hunted animal. She has aged before her time her features and figure were those of a woman of thirty, but her hair was shot with premature grey and her expression was weary and haggard. The stereotypical view of women has changed a lot over the last century. In the times that The Speckled Band was written women were seen as frail people who needed help from big strong men. In the 1920s Agatha Christie wrote books where a woman solved murder cases but people still thought she was stupid. Now in the year 2003 there are women who command entire police forces. In my opinion I dont think that The Speckled Band is very effective as a murder mystery because it is too obvious that Roylott is the killer. It is very good as a how-dun-it because its frustratingly hard to workout how Roylott killed his stepdaughter. Conan Doyle included a red herring into the story to try and throw us off course but I dont think it works at all. Its almost as if he just put it in at the end as a rushed job. Safeguarding the Welfare of the Child Essay Emma Cummings ‘Young children are vulnerable. They develop resilience when their physical and psychological well-being is protected by adults’ (EYFS card 1.3) The  Early Years Foundation Stage (EYFS)  sets standards for the learning, development and care of children from birth to 5 years old. The  EYFS framework  supports an integrated approach to early learning and care. It gives all professionals a set of common principles and commitments to deliver quality early education and childcare experiences to all children and gives parents reassurance that regardless of where they choose for their child’s early education, they can be assured that the same statutory commitments and principles will underpin their child’s learning and development experience. The statutory framework has three sections. The learning and development requirements Assessment The safeguarding and welfare requirements Child protection and safeguarding children is of paramount importance in early years settings. All members of staff must be suitable and providers are required to carry out enhanced criminal record checks on any individual working directly with the children. The EYFS Framework requires all settings provide a policy and have procedures in place to safeguard children. Practitioners are required to be alert to any concerns about a child. All staff in the setting should be trained to recognise the signs of abuse. These may include: Significant changes in children’s behaviour Deterioration in children’s well- being Unexplained bruising, marks or signs of possible abuse or neglect Children’s comments which give cause for concern Any reason’s to suspect neglect or abuse outside the setting, for example in the child’s home Inappropriate behaviour displayed by other members of staff, or any other person working with the children. For example: inappropriate sexual comments, excessive one to one attention beyond the requirements of their usual role and responsibilities, or inappropriate sharing of images. Good. All settings are required to have a designated staff member to take the lead responsibility for safeguarding children, known as Safeguarding of Children Co-ordinator (SOCCO) who will complete a course on safeguarding children. For children who need additional help, every day matters. Research is consistent in underlining the damage to children from delaying intervention. Safeguarding and promoting the welfare of children is defined as protecting children from maltreatment, preventing impairment of childrens health or development, ensuring that children grow-up in circumstances consistent with the provision of safe and effective care and taking action to enable all children to have the best outcomes. The actions taken by professionals to meet the needs of these children as early as possible can be critical to their future. (Department for Education-Working to Safeguard Children) The statutory requirements promote the safeguarding and welfare of all children when they are healthy, safe and secure and when their individual needs are being met. A positive relationship with adults caring for the children is vital. Settings should be welcoming, safe, secure and stimulating. Providers must take all necessary steps to keep children safe and well from safeguarding, suitability of adults in contact with the children, promoting good health, managing behaviour and maintaining policies and procedures. All early years settings are required to have at least one member of staff present at all times who holds a full Paediatric First Aid qualification. The 1st aid boxes must be fully stocked to administer treatment for minor injuries following guidelines from the Health and Safety Executive Website. The setting must have a procedure in place for recording accidents and incidents either by an accident form or accident book. Food and drinks provided in the setting must be heal thy, balanced and nutritious. Before the children start in the setting providers must establish any special dietary needs. Tables used for meal times must be disinfected before and after meal time. Children wash their hands before eating. Providers are responsible for dealing with behaviour in an appropriate way, under no circumstances must practitioners threaten or give any corporate punishment to the children, behaviour should be dealt with calmly and fairly in all circumstances so that we are not having an adverse effect on the child’s well-being. During outings children must be kept safe, providers must assess the risks or hazards which may arise and identify steps to be taken to remove, minimise and manage those risks and hazards. If children are travelling in a vehicle the driver must be adequately insured. (Statutory framework for the early years foundation) Good. The obvious starting point of keeping children safe in the setting is to ensure that basic principles are being followed. No matter how good the security of a building is, the doors must be closed properly at all times, otherwise all other efforts are likely to be worthless. The message that safety begins with individuals taking responsibility for simple things cannot be overemphasised. A safe environment must meet its registration requirements; there are two registers, the Early Years Register (EYR) and the Ofsted Childcare Register (OCR). Settings which provide day care for children under five have to be registered on the EYR. Meeting registration requirements means that a setting will be complying with the law and legislation, but providing and maintaining a safe environment requires a greater understanding from everybody involved. A safe environment starts with the child and will include: The physical environment the actual building in which care is provided indoor and outdoor areas where children learn, play and develop must be accessible for users whilst maintaining levels of security that keep children safe and protected from harm. The people those providing care are â€Å"suitable† persons (as defined in the EYFS Welfare Requirements) and others who have contact with the children and premises are appropriate to do so. Equipment play equipment and care equipment which is fit for purpose, appropriate for the needs of individual children and meets the guidelines for British and European standards. The emotional environment – which enables children to grow, develop and reach their full potential, with opportunities to explore and take appropriate risks, enabling children to try out new skills and increase their knowledge and understanding of the world around them, through experiences which are both planned and unplanned. Documentation policies and procedures and records that support all of the above which have clearly set out duties, responsibilities and actions. Good. When working with young children who are vulnerable, the challenges for creating and managing a safe environment are different again. Practitioners must work closely with a child’s parents to address aspects which may not be covered in a risk assessment, but still need to be considered for an individual child’s well-being. The environment is just one aspect of keeping children safe and protected. If practitioners  identify a child who is vulnerable or in need of protection, action must then be taken using policies and procedures already in place and tools such as the Common Assessment Framework. Parents’ awareness of the setting’s policies and procedures for safeguarding children promote confidence about safety and this will be reflected in their child’s experiences. All settings must be aware of the procedures for dealing with concerns about a child’s welfare. Although there is a big emphasis on keeping children safe in early year’s settings and where practitioners try to minimise risks, children need and instinctively want to be able to take risks in order that they can test their abilities and strengths. There’s no better environment for them to do so than that of an early years setting where practitioners will already have removed hazards not readily identifiable to young children and will provide well managed opportunities for appropriate ‘risk taking’ to take place. Children need support to take some risks as part of their learning and development. Children with disabilities do not always have the freedom of choice compared to their more able peers, yet have the same need for opportunities to take risks. It is the responsibility of early year’s practitioners to assess and manage the level of risk in the environment. Providers are required to conduct regular risk assessments, which identify aspects of the environment that need to be checked on a regular basis. The process should then involve deciding what should be done to prevent harm, making sure that the relevant actions are taken and are updated whenever necessary. Early years settings should already have comprehensive health and safety risk assessments that inform their procedures and a competent person identified to be in charge of the implementation. Good point. All settings have a duty to minimise risk in all situations. When creating a safe environment for children, practitioners must consider their legal duty to identify and reduce/eliminate risks, with a balance of proportionate/acceptable risk. The risk of falling of slide is quite high, however the risk can be minimised by adult supervision and soft landing mats, turn taking rules etc. Children can indulge in their natural instincts of risk taking unaware that the risk has been assessed and minimised by the practitioner. The EYFS requirements ensure that essential standards of provision are in place. Providers are required to carry out regular risk assessments, which identify aspects of the environment that need to be checked on a regular basis. The assessment should then involve deciding what can be done to prevent harm ensuring actions are taken and updated whenever necessary. Health and safety law does not expect all risk to be eliminated but that ‘reasonable precautionsâ€⠄¢ are taken and that staff are trained and aware of their responsibilities, thus creating an environment that enables children to grow and develop being able to take risks through physically challenging play. Early years settings should already have comprehensive health and safety risk assessments that inform their procedures and a competent person identified to be in charge of the implementation. Staff in all settings regardless of their level should be involved in reviewing these, as they are the ones with the first- hand knowledge as to whether they are effective and can give an informed view to help update procedures. Parental involvement should also be welcomed, they should be aware of their responsibilities, such as closing gates behind them and being aware of strangers entering the building and being encouraged to make staff aware. The basis of effective risk management is that everybody is involved and can therefore take responsibility for their, and others safety. Risk ass essments such as security of the building, fire safety, food safety, bathroom hygiene and nappy changing, and personal safety of staff should already exist. What we are doing with the children during the session also requires a risk assessment such as a cooking activity or an outing. Risk assessments are necessary when making reasonable adjustments for disabled children/children with additional needs. Minor accidents being recorded would also require action. Whatever the reason for the risk assessment, the process remains the same. Risk assessment processes identify five steps that we need to take: Identification of risk or hazard – where it is and what it is? Decide who is at risk and how – childcare staff, children and parents Evaluate the risks and decide on precautions – can we get rid of the risk altogether, if not how can we control it? Record our findings and implement them – prioritise, make an action plan if necessary. Monitoring and review – how do we know if what has been decided is working, or is it thorough enough? If it is not working, it will need to be amended, or maybe there’s a better solution. Safety sweeps are another way of assessing risks, we often do these in our setting either first thing or at the end of the session. Our safety sweeps aren’t recorded unless we identify a risk that needs assessing. It is also helpful for members of staff at all levels to be familiar with the key legal requirements that affect their day to day practice and know where to access updates and further information. The Easter Vigil: The Primary Liturgy. Which Shows The Church As A Sac :: essays research papers

Every year, on the day before Easter, one of the biggest and most important masses of the year happens on that night. The mass is called the Easter Vigil. The Vigil brings out the true and full nature of the Catholic Church and all of its people. It celebrates Jesus Christ, as he rises from the dead and ascends into heaven. Since this mass is so large, it is split into four parts. The first, the Service of Light, and is the most solemn part of the mass the Church celebrates. The second part is the Liturgy of the Word, in which you listen to a reader who reads from the books of the Bible such as Genesis and Exodus. The third part of the celebration is known as the Celebration of the Rites of Initiation. At this point people become part of the Church and receive such sacraments as Baptism, Communion, and Confirmation. The fourth part of the vigil is the Liturgy of the Eucharist. The Liturgy of the Eucharist is the climax of the Easter Vigil. The Easter Vigil is the biggest mass in the Church and it requires four parts in the Service of Light, The Liturgy of the Word, the Celebration of the Rights of Initiation, and the Liturgy of the Eucharist, but also requires much more faith and concentration to fully appreciate it.   Ã‚  Ã‚  Ã‚  Ã‚  The first part of the Easter Vigil is the Service of Light. The Service of Light is the most solemn time during the Easter Vigil and where the people of the Catholic Church show the most respect. All the lights in the Church are turned off. The minister carries the paschal candle slowly into the Church. As the candle is shared with the rest of the congregation, the atmosphere is very dark and glum. As the minister brings the candle towards the altar, the following response is sung by the pastor and by everyone else in the Church. The Deacon or the Celebrant sings â€Å"Christ our Light† and everyone responds, â€Å"Thanks be to God†. This is done three times and after this the choir sings the Exultet. The focus on signing is of the risen Jesus Christ. After, the paschal candle reaches the altar; it is placed on a stand next to the lantern. This marks the ending of the first part of the Easter Vigil, the Service of light.   Ã‚  Ã‚  Ã‚  Ã‚  The second part of the Easter Vigil is the Liturgy of the Word.

Mary Catherine Bateson's Improvisation In a Persian Garden, Annie Dillard's Seeing and Leslie Marmon Silko's Landscape, History, and the Pueblo Imagination This paper will analyze Improvisation In a Persian Garden (Mary Catherine Bateson), Seeing (Annie Dillard), and Landscape, History, and the Pueblo Imagination (Leslie Marmon Silko). Going through the Purpose, audience, context, ethics, and stance of each author’s piece. All three stories show the reader what each author sees. All three authors write of an event that took place in their individual lives. Both Dillard and Bateson go back and forth between the past and the present, while Silko talks of events that took place only in the past. In Seeing, Annie Dillard writes about the things people do not see, and the things people choose to see. Dillard does this to make the reader aware of what is around them. People have the attitude of â€Å"what you see is what you get.† (Dillard pg. 13) Dillard believes that people do not actually want to see what is really there. That people only want to see what makes them happy. Dillard goes on to discuss all the things we see and do not see, ending by stating â€Å"if we are blinded by darkness, we are also blinded by light†. (Dillard Pg.17) Dillard is saying that if you look hard enough there is always something to see. Improvisation in a Persian Garden Bateson wants the reader to see, how adults do not always see things better than children. The author (Bateson) is trying to explain the sacrifice of a sheep to her two-year-old daughter. The author wants other parents to have an idea, as to how to educate a young child in this sort of situation. Bateson begins to notice that she too is learning something for the first time â€Å"beca... ...ose to see, and start seeing what you are afraid to see. In Improvisation in a Persian Garden Bateson writes as herself twenty years earlier. Dillard takes a different view writing not as herself but as a child. Silko writes in the present state with memories of what was heard as a child. Each story is dealing with how people see different things and why. Bateson and Dillard are the most alike with Silko being the most different. The first two both describe everything around them. Silko describes what she hears not sees through his own eyes. Renaissance and Reformation Essay -- Changes, Influence, Origin

The European Renaissance was characterized by advancements and new developments in literature, science, religion, politics, and most importantly artwork. It proved to be a reappearance of learning based on classical sources. The renaissance was not as widespread as one would think. Essentially it is described as a time of cultural movements rather than technological advancements. Its time period ranged roughly from the 14th century to the 17th century. There is debate as to how far the movement stretched and exactly how many areas were influenced by the renaissance era. The European Renaissance is thought to have originated in Florence, Italy in the 14th century, and occurred after the Black Death. The Black Death was a disease which affected all of Europe. It caused about a third of the population of Europe to die out. The survivors were devastated at the loss of their loved ones, but they found that they were better off financially and socially, making their way up the social ladder. Specifically in Italy, there was greater social mobility. The upward mobility of individuals around this time allowed them to patronize early artists and rebuild libraries. Some areas were seeing more competitively between workers and their bosses, but the 'new' wealth was spent to display items to reinforce prestige. This allowed citizens to patronise the Renaissance artists. Merchants in regions like Italy saw increases in their wealth from trading, using the same trade routes in which the Black Death was spread. The trade income was further developing by Renaissance developments in commerce, causing the merchants to have more wealth to patronise with. The Renaissance brought on new conceptions of life and ... ...such as Italy and Germany. Italy and Germany's economy went bankrupt, causing an increase of famine and disease to spread throughout the populace. The main effect the Reformation had on Europe was the religious thinkings. The Churches now taught the importance of the individual conscience and gained new purity and strength through counter Reformation. The counter Reformation was created by the Catholic Churches as an answer to the Protestant Reformation. Both the Renaissance and the Reformation helped shape all countries today. The Renaissance helped people focus more about the individual person rather than the social class in which they were born. The Reformation was a building block to more forms of Christianity that are still taught today, such as Protestantism. If we had not had either of them, our religion, politic, and even our writing would be different.

Contractual and Non Contractual Liability Essay

I. Contract   A contract is an agreement having a lawful object entered into voluntarily by two or more parties, each of whom intends to create one or more legal obligations between them. The elements of a contract are â€Å"offer† and â€Å"acceptance† by â€Å"competent persons† having legal capacity who exchange â€Å"consideration† to create â€Å"mutuality of obligation. † Contracts may be bilateral or unilateral. A bilateral contract is an agreement in which each of the parties to the contract makes a promise or set of promises to each other. For example, in a contract for the sale of a home, the buyer promises to pay the seller $200,000 in exchange for the seller’s promise to deliver title to the property. These common contracts take place in the daily flow of commerce transactions, and in cases with sophisticated or expensive promises may involve extensive negotiation and various condition precedent requirements, which are requirements that must be met for the contract to be fulfilled. Less common are unilateral contracts in which one party makes a promise, but the other side does not promise anything. In these cases, those accepting the offer are not required to communicate their acceptance to the offeror. In a reward contract, for example, a person who has lost a dog could promise a reward if the dog is found, through publication or orally. The payment could be additionally conditioned on the dog being returned alive. Those who learn of the reward are not required to search for the dog, but if someone finds the dog and delivers it, the promisor is required to pay. Elements At common law, the elements of a contract are offer, acceptance, intention to create legal relations, and consideration. Offer and acceptance In order for a contract to be formed, the parties must reach mutual assent. This is typically reached through offer and an acceptance which does not vary the offer’s terms, which is known as the â€Å"mirror image rule†. If a purported acceptance does vary the terms of an offer, it is not an acceptance but a counteroffer and, therefore, simultaneously a rejection of the original offer. Intention to be legally bound In commercial agreements it is presumed that parties intend to be legally bound unless the parties expressly state the opposite as in a heads of agreement document. For example, an agreement between two business parties was not enforced because it contained an ‘honor clause’ which stated the parties wish that the agreement not be reviewed or enforced by a court. In contrast, domestic and social agreements such as those between children and parents are typically unenforceable on the basis of public policy. For example, a husband agreed to give his wife $100 a month while he was away from home, but the court refused to enforce the agreement when the husband stopped paying. Consideration is something of value given by a promissor to a promisee in exchange for something of value given by a promisee to a promissor. Typically, the thing of value is a payment, although it may be an act, or forbearance to act, when one is privileged to do so, such as an adult refraining from smoking. This thing of value or forbearance from some legal right is considered to be a legal detriment. In the exchange of legal detriments, a bargain is created. II. Contractual Liability Contractual liability, is exactly as it sounds.
